Costco, one of America's largest retail giants, has filed suit against President Donald Trump's administration before the US Court of International Trade (USCIT), seeking refunds for tariffs paid throughout the year. The Trump administration imposed global-level levies on numerous products in 2025 using IEEPA (International Emergency Economic Powers Act) authorities under a self-declared national emergency. Costco's move comes as the Supreme Court continues its examination of the legality of these tariffs.


In the suit filed on November 28, Costco aims to halt liquidation operations scheduled for December 15 by U.S. Customs and Border Protection (CBP). If liquidation proceeds, it becomes both legally and procedurally extremely difficult for importers to subsequently seek tariff refunds. For this reason, the company emphasizes the urgent nature of the process, stating that the "Plaintiff seeks relief from the impending liquidations to ensure that its right to a complete refund is not jeopardized".


What Is the Supreme Court Examining?

Costco's lawsuit rests on the same legal grounds as two consolidated cases pending before the High Court (Learning Resources Inc. et al v. Trump and V.O.S. Selections Inc. et al v. Trump):

  • Can the 1977 statute, despite not explicitly granting tariff authority, be interpreted to permit such application?

During oral arguments on November 5, most Supreme Court justices approached the Trump administration's defense of using IEEPA as a tariff tool with skepticism.
The justices' questions reflected clear concerns about the constitutional limits on the executive branch's ability to indirectly seize Congress's tariff powers by declaring an economic emergency.


Why Is Costco Filing Suit Now?

According to the company's submission, waiting for the Supreme Court to rule is insufficient. Because:

  • Even if the Court finds the tariffs unlawful,

  • it is not guaranteed that importers will automatically obtain refund rights.

Costco points out, using the phrase "importers are not guaranteed a refund in the absence of their own judgment", that each importer may have to obtain individual judicial relief. For this reason, Costco is seeking both an injunction to halt future IEEPA tariffs and a full refund of all tariffs already paid.


Other Companies Are Joining the Lawsuits

Costco is not alone in this matter. Revlon, Bumble Bee Foods, and numerous other companies have filed similar suits this year over IEEPA levies applied nationwide. Legal proceedings initiated by seven small businesses and twelve states throughout the year are based on claims that the tariffs constitute presidential overreach.


Macro Impact: Potential "Historic" Tariff Refund Wave

According to PwC, the United States has collected $108 billion USD in IEEPA tariffs through the end of October 2025. Should the Supreme Court find the tariffs unconstitutional and order refunds, CBP could face what has been described as America's largest refund wave in history.


Experts warn that this situation could exceed CBP's operational capacity, create complex repayment processes spanning years, and introduce uncertainty in companies' cash flow planning.


Costco's Strategic Stance

Because Costco is a retailer with high sales volume despite its low-margin business model, tariffs applied to its broad product portfolio directly raise the company's cost base. For this reason, the company:

  • is taking an aggressive legal position,

  • is rapidly preparing a preliminary injunction to halt liquidation operations,

  • is working to protect its refund rights independently of the Supreme Court.
